General Terms and Conditions (GTC) – Dvin Numismatik KlG

1. Scope; Definitions

These General Terms and Conditions (“GTC”) govern the contractual relationship between Dvin Numismatik KlG (“Seller”) and the respective buyer (“Buyer”) for all purchases concluded via the MA-Shops platform.

2. Offer; Conclusion of Contract

All information, images and descriptions in offers are provided to the best of our knowledge and belief. Minor deviations (e.g. due to photography/lighting) do not constitute a defect.

Offers are non-binding and valid only while stocks last; prior sale is reserved.

By placing an order, the Buyer submits a binding offer. The contract is concluded as soon as the Seller confirms the order electronically (order confirmation).

3. Prices; Payment; Foreign Duties and Charges

All prices are stated in EUR unless indicated otherwise. For deliveries within Switzerland, Swiss VAT will be added to the listed prices. Shipping costs are shown separately in the offer/checkout.

Payment is made using the payment methods offered by MA-Shops; shipment/handover takes place only after full receipt of payment.

The Buyer bears all costs/duties/charges incurred abroad, in particular import VAT/sales tax, customs duties, levies, customs clearance fees, and any other costs charged by authorities or third parties.

Import/Customs; Foreign Regulations: The handling of import/customs formalities and compliance with the customs, import and, where applicable, foreign exchange regulations in the destination country are solely the Buyer’s responsibility; the Seller is not liable for damages resulting from violations of such regulations, to the extent permitted by law.

4. Shipping; Delivery Time; Insurance

Shipping is made from Switzerland to the delivery address provided by the Buyer. Delivery times are non-binding estimates and may be extended in particular due to import clearance, inspections, peak periods, or measures taken by authorities/transport service providers.

Shipments are sent insured; compensation in the event of loss/damage is governed by the insurance terms and conditions of the transport service provider/insurer.

After receipt of the tracking number, the Buyer (or the recipient designated by the Buyer) must track the shipment, clarify import/customs formalities in a timely manner, and provide any required information/documents without undue delay upon request. Any costs incurred by the Seller due to returns, repeated delivery attempts, or incorrect/unclear address details will be invoiced to the Buyer.

5. Authenticity; Warranty; Returns

The Seller warrants the authenticity of the goods as described. This warranty applies exclusively to the Buyer and is not transferable.

Apart from the authenticity warranty, no further warranties apply except as required by mandatory law.

The Buyer must inspect the goods promptly upon receipt and notify the Seller in writing of any apparent defects within 14 days of receipt; non-apparent defects must be notified in writing within 14 days of discovery.

For coins in so-called “slabs”, any warranty/warranty claim lapses once the slab has been opened.

Returns are only possible after prior arrangement with the Seller, unless mandatory law provides otherwise. The goods must be returned in their original condition and properly packaged.

In the event of authenticity disputes, Buyer and Seller will first seek an amicable resolution. The Seller may obtain non-binding opinions from recognized experts.

6. Liability; Force Majeure

Liability for indirect or consequential damages (e.g. lost profit, loss in value) is excluded to the extent permitted by law. In cases of force majeure (strikes, transport disruptions, official measures, etc.), no liability is assumed for delays or non-performance, to the extent permitted by law.

7. Governing Law; Jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection provisions of the Buyer’s country of residence provide otherwise.

Place of performance and exclusive place of jurisdiction is Zurich, Switzerland, to the extent permitted by law.

8. Language; Severability

In case of discrepancies between language versions, the German version shall prevail.

Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected; the invalid provision shall be replaced by a provision that comes closest to the intended economic purpose.
