General Terms and Conditions

Manuel Singer Münzen & Medaillen

I Scope of Application

a. These General Terms and Conditions (GTC) of Manuel Singer Münzen & Medaillen (hereinafter referred to as the “Seller”) apply even if no further reference is made to them. Any terms and conditions other than those contained herein shall apply only if expressly accepted by the Seller in writing. These GTC apply exclusively to all sales and deliveries made by the Seller’s trading business to consumers or businesses (hereinafter referred to as “Customers”). They also apply to subsequent transactions, even if no further reference is made to them.

II Conclusion of Contract and Obligations to Perform and Deliver

a. As a general rule, the Seller delivers worldwide. Delivery restrictions affecting countries that cannot be supplied due to special circumstances (e.g. war) are updated on an ongoing basis.

b. The Seller’s offers do not constitute binding offers to the Customer. Orders become binding only when the Seller has expressly confirmed them.

c. A legally binding contract is concluded when the Customer completes and confirms the online ordering process and the Seller confirms or fulfils the order.

d. If delivery cannot be made due to force majeure or other circumstances for which the Seller is not responsible, the Seller is entitled to withdraw from the contract. In such cases, the Customer has no claim for damages. However, the Customer will be notified without delay, and any payment already made will be refunded.

e. Partial deliveries may be made unless it is apparent that the Customer has no interest in them or that they would be unreasonable for the Customer.

III Prices and Payment Terms

a. The prices displayed on the website at the time the order is placed shall apply.

b. Goods are delivered exclusively against advance payment. Payment is therefore due immediately upon conclusion of the contract.

c. The Customer agrees to delivery by shipment unless expressly agreed otherwise.

IV Warranty

a. In the event of defects in the goods, the Seller’s warranty obligations and liability for damages are governed by the statutory provisions.

b. Each delivery must be inspected without delay to verify that it is in proper condition and complete. Any defects must be reported and substantiated as soon as possible after receipt of the products.

V Retention of Title

a. The purchased item or goods remain the property of the Seller until the purchase price and all associated costs and expenses have been paid in full.

VI Liability

a. The Seller is liable in cases of wilful misconduct or gross negligence of any kind, and in cases of intentional or negligent harm to life, bodily integrity or health.

b. In addition, where the Seller acts with gross negligence in breach of a material contractual obligation, liability is limited to the foreseeable damage typical of the contract. Material contractual obligations are obligations imposed on the Seller under the terms of the contract that are necessary to achieve the purpose of the contract.

VII Anti-Money Laundering Provisions

a. Compliance with statutory anti-money laundering provisions is a mandatory basis of every business relationship between the Seller and the Customer. The Customer acknowledges this and authorizes the Seller to make all related reports and other declarations. The Customer also undertakes to cooperate, to the extent required in each case and whenever necessary, in complying with all anti-money laundering provisions.

VIII Applicable Law

a. The contracting parties agree that Austrian law shall govern all legal relationships arising from this contractual relationship, both present and future, including after performance of the contract, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Severability Clause

If individual provisions of these GTC are or become void, the remaining provisions shall remain effective.
